Terms and license

Effective [[EFFECTIVE DATE]]

These terms are the license agreement for Makitro (the free app) and Makitro Pro (the paid upgrade). They're written to be read. By installing Makitro or buying Makitro Pro, you agree to them.

Makitro is made by [[LEGAL NAME]] ("we", "us"), [[POSTAL ADDRESS]]. Contact: [email protected].

1. The software is licensed, not sold

We own Makitro and all rights in it. These terms give you a license to use it; they don't transfer ownership.

2. Makitro (free)

You may download, install and use the free version of Makitro on any number of Macs you own or control, for personal or business use, at no charge.

3. Makitro Pro

4. Purchases through Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to the purchase itself: payment, sales tax and VAT, invoices and refunds. These terms cover your use of the software.

5. Refunds

You can get a full refund within 14 days of purchase, no questions asked. See the refund policy. After a refund, your Pro license is no longer valid and you agree to stop using the Pro features and remove the license from your Macs.

6. What you may not do

7. Third-party components

Makitro includes open-source components (such as Sparkle) under their own licenses, which are included with the app. Those licenses apply to those components.

8. Privacy

Makitro keeps your data on your Mac. The privacy policy explains what the app and this website store and send.

9. No warranty

Makitro is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that it will be error-free, uninterrupted, or compatible with every Mac, accessory or future version of macOS. Some places don't allow excluding implied warranties, so some of this may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of or inability to use Makitro. Our total liability for any claim relating to Makitro is limited to the amount you paid for Makitro Pro in the 12 months before the claim, or USD 15 if you paid nothing. Nothing in these terms limits liability that can't be limited by law, such as for fraud, gross negligence, or death or personal injury caused by negligence, or your statutory rights as a consumer.

11. Termination

Your license ends automatically if you materially break these terms. You can end it at any time by deleting Makitro. Sections 1 and 6 to 12 survive termination.

12. Governing law

These terms are governed by the laws of [[GOVERNING LAW: COUNTRY / STATE]], without regard to conflict-of-law rules. Disputes will be heard in the courts of [[COURTS / VENUE]], unless the consumer law of the country where you live gives you the right to bring a claim in your local courts or under your local law.

13. Changes

We may update these terms for future versions. The version in effect when you bought Makitro Pro continues to apply to that purchase unless you agree to a newer version.
